Terms of Service

By clicking the Process Payment button on the Quote and checking the box on the Booking Form, each Client and Love & Moore ("Company") agree to enter into this Wedding Photography and/or Videography Contract.

1. Scope of Work

Love & Moore shall provide services per the package listed on the Quote and Contract Sales Order.

2. Payment Terms

• Primary Payment: Check.
• Credit/Debit: Accepted with a 4% convenience fee per transaction.
• Installments: An additional 5% fee of the total contract applies if selected.
• Refunds: All deposits and retainers are non-refundable. Exception: The initial Quote deposit is refundable within 3 days unless the Booking Form has already been submitted.
• Deadline: Balance must be paid in full at least 60 days prior to the event.

3. Overdue Payments and Defaults

Overdue payments are subject to a 13% interest rate per missed invoice after a 5-day grace period. Failure to pay deems the Client in default. Love & Moore reserves the right to cancel the event while remaining entitled to the original contract price and damages. Client is liable for all collection and legal costs.

4. Credit Card Disputes

Client agrees to pay a $500.00 fee for any credit card dispute or chargeback attempt. If a chargeback is proven false, Client is liable for all dispute resolution expenses plus the $500 fee.

5. Change of Event Details

Immediate written notice to contact@loveandmoore.com is required for any change in date, time, or location. Love & Moore may deem a change as a cancellation or accommodate it at the current market rate.

6. Cancellation Policy

Love & Moore reserves your date exclusively. In the event of cancellation for any reason, Client is responsible for 100% of the total contract price as liquidated damages. All retainers are non-refundable. Any outstanding balance must be paid within 10 days of cancellation.

7. Venue and Planning Requirements

• Permits: Client is responsible for all venue permits, licenses, and associated fees.
• Booking Form: Must be received within 72 hours of the deposit or Love & Moore may cancel without a refund.
• Planning Docs: Must be completed at least 8 weeks before the wedding.

8. Limitations of Liability

Love & Moore is not responsible for requested photos or video missed due to weather, schedule complications, or venue restrictions. In cases of Acts of God, Love & Moore will provide a non-refundable credit for a future date but holds no further liability.

9. Exclusivity and Substitution

Love & Moore shall be the sole professional photography or videography service employed. Love & Moore reserves the right to substitute a qualified backup talent if the assigned talent is unavailable. Substitution is not a breach of contract.

10. Travel, Meals, and Extended Coverage

• Expenses: Client reimburses for tolls, parking, and transportation.
• Travel Fees: Applied if location is 90+ miles round trip from Chicago or requires overnight stays ($150/night per shooter).
• Meals: If no meal is provided, staff is allowed a 1-hour break from the site.
• Overtime: Billed at $100.00 per half-hour per staff member.

11. Media Delivery and Deletion

• Proofing: Online galleries typically available within 3 to 10 weeks.
• Download Window: Client has 14 days to download final media after receiving the gallery link.
• Deletion: Files are deleted from our servers after the 14-day window. Love & Moore is not liable for deleted content if the Client fails to download it in time.
• Un-archiving: If files are still available but archived, an un-archiving fee applies.

12. Model Release and Copyright

Client grants Love & Moore rights to use all photos or video for advertising, social media, and promotion. Love & Moore retains ownership of all digital files. It is illegal to copy, scan, or reproduce images without written permission.

13. Governance and Breach

Any legal disputes shall be brought in the courts of Cook County, Illinois. If Love & Moore prevails in any action, Client is responsible for all legal fees, filing costs, and administrative expenses. Damages are strictly limited to the amount of money paid by the Client to the Company.
